That's odd... I assume you mean you can't sell to consumers in that state, but that doesnt mean the affiliate would be targeting that state. Why would it matter that the affiliate lives there. They'd be marketing nation-wide not by state. Ive never heard of anything prohibiting affiliates from a state.
